Questions that come before the phone call
If yours is not here, ask on the first call.
Getting started
How do I know if bankruptcy is right for me?
It depends on what you owe, what you earn and what you want to keep. The first call is for that. Sometimes the honest answer is that it is not the right move yet.
How long does it take?
A Chapter 7 case usually runs a few months. A Chapter 13 plan runs three to five years.
Will creditors stop calling?
Once a case is filed, the law generally requires them to. Brigitte can also tell them in writing before then that you have a lawyer.
Costs
What does it cost?
The first call is free. After that, our attorney fee is quoted in writing, and the court charges its own filing fee on top. You see the total before you agree.
Can I pay over time?
Yes. We can split the attorney fee into monthly payments before filing, or fold it into a Chapter 13 plan.
Is there a fee for the credit course?
Yes. Credit counseling and the debtor education course are paid to approved providers, and they are usually modest.
Your things
Will I lose my home?
Not automatically. What happens depends on your equity, your mortgage and the chapter you file under.
What about my retirement account?
Most retirement accounts are protected by law. Bring a statement and we will confirm.
Do I have to list every debt?
Yes, including money you owe family or friends. Leaving one off can cause problems later.
